Important: Please read carefully before clicking on the booking form that you understand and agree with the terms and conditions. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them. Not only providing you with detailed descriptions of what sets your trek or activity apart from the rest, it also is necessary to provide all the nitty gritty of the provisions and terms associated with the booking or reservation. Indian Summits Contract-
The booking conditions constitute a legally binding contract between Indian Summits and the services provided by Indian Summits. Booking must be made by person older than 18 years. By booking with Indian Summits and paying the refundable (conditions apply. See below) full payment, you acknowledge that you have read, understood and agree to be legally bound by these booking conditions. Acceptance of your booking will be confirmed in writing to you and a contract becomes binding on the date shown on your confirmation letter or email.
Prices are based on cost and exchange rates applicable when the brochures and website were updated. Indian Summits reserves the right to adjust prices whether or not you have made full payment. Indian Summits will do everything within its control not to adjust prices and will only adjust or amend prices in the unfortunate event of increased exchange rates, fuel cost (imposed on Indian Summits) and other operating cost on which prices are based. Dates and itineraries departing in 2017 /2018 are subject to change. Airfares ( except where stated), travel insurance, passport and visa fees, excess luggage charges, airport taxes, tips to guides and porters, extra meals ( unless otherwise stated), laundry, drinks, medical expenses, optional extra activities or treks, and any items of a personal nature are not included in your trek price.
Amendments / Cancellations:
Full payment should be made at the time of booking. If cancellation is made more than 60 days prior to departure, full booking amount is refunded.. If cancellation, which must be in writing is received after that time, the following scale of cancellation charges of the entire trek apply. These charges are to cover the expenses incurred towards the advance preparation required of treks booked. Name changes are allowed only 30 days prior to the start of the trek. Name changes before 15 days of trek are considered as cancellation and the new name will be taken as a new booking. In this situation all clauses referring to cancellation charges will apply. No amendments will be permitted 15 days before departure.
For bookings made within 15 days prior to departure Indian Summits reserves the right to charge a late booking fee of Rs.3000 per booking. It is not possible to accept late bookings on some treks.
Trek Cancellation by Indian Summits
Indian Summits reserves the right to cancel a departure and will advise you of such cancellation no later than 30 days before the tour departure date. If due to ‘Force Majeure’ (unforeseeable conditions) or government travel advice, Indian Summits reserves the right to cancel departure, including a guaranteed one, at any time. With any form of cancellation, Indian Summits will offer you alternative arrangements, and if the price of your alternative booking is of lower value than the original booking Indian Summits will refund the difference to you. If you do not accept alternative arrangements Indian Summits will refund all payments you have made to Indian Summits, (in case of ‘Force Majeure’ or government travel advice, refunds will be less any unrecoverable costs). Indian Summits will not be liable for any additional cost incurred by you for any damages or claims in connection with these cancellations.
Indian Summits will not be liable for any delay in, change to or cancellation of treks due to ‘Force Majeure’. ‘Force Majeure’ means a circumstance beyond the reasonable control of Indian Summits and includes, but is not limited to, war or threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire and strikes.
Changes to your holiday:
You acknowledge that travelling with Indian Summits requires a degree of flexibility, good humour and an understanding that the itinerary accommodation, and / or modes of transport may change, even after a tour’s commencement, without prior notice due to local circumstances. Changes may occur because of ‘Force Majeure’, poor road conditions, weather, and the availability of government and tourism permissions, vehicle breakdowns, changes in transport schedules, accidents or other circumstances beyond Indian Summits’ control or which simply cannot be foreseen. Indian Summits does not accept any responsibility for loss of enjoyment, delays or compensation resulting from circumstances beyond Indian Summits’ control. You acknowledge that group sizes may also vary during the duration of the tour. The information about treks given in any brochures, trek notes and pre departure information are subject to change. It is your responsibility to review up – to – date trek notes and pre departure information. These can be obtained from Indian Summits website. The information and conditions in the trek notes and pre departure information are deemed to be part of the contract. Where changes to your trek occur after you have received your final documentation we will, where practical, advise you or your agent of such changes.
Health and fitness:
Indian Summits expects all travellers to be of moderate fitness. If you suffer from severe muscular, chest, heart, asthmatic, or bronchial disorders, or have high blood pressure you are advised against coming on Indian Summits trekking treks that go to altitude. All travellers over the age of sixty will be required to obtain a medical certificate of fitness. If you fail your medical, a full refund of deposit paid will be made, providing the medical as requested by Indian Summits is returned within two weeks of booking.
Please note: Discovery of any undisclosed medical conditions will result in you being asked to leave the trek.
Indian Summits reserves the right to cancel your participation in a trek at any time after trek commencement with no right of refund if your lack of fitness (for the grading of the booked trek), medical condition and/or disability could reasonably affect the trek or your safety and/or the enjoyment of other trek members.
Personal travel insurance is not included in the trek price. While every effort is made to ensure the safety for all, it is compulsory and a condition of Indian Summits terms and conditions of accepting you on a trek, that you obtain personal travel insurance that is adequate to cover you for any event. Your travel insurance must cover accidents, injury, illness and death medical expenses, including any related to pre-existing medical conditions, emergency repatriation (including helicopter rescue and air ambulance where applicable) and personal liability. Indian Summits also recommends your travel Insurance covers cancellation, curtailment and loss of luggage and personal effects.
Pick up and Drop off
Trekkers are picked up and dropped off at railway station or airport as per trek chosen (Check inclusions and exclusion). Often, trekkers are grouped and share cabs.
Managing your gear
It is assumed that trekkers carry their own gear(clothes, warmers, kit, etc) in backpacks. Camping equipment like tents, sleeping bags, food etc will be carried by Indian Summits staff. In case you decide not carry your own stuff, you may engage a porter at an additional cost. You can offload upto 10 kgs. of weight incase you take up porter. Cost does not lower if your gear weighs less. Also, only backpacks are carried. No suitcases, trolleys, etc are allowed. Remember, the terrain is difficult for such items. You need to notify us well in advance for us to be able to secure a porter.
All the treks invariably have certain risks and rewards associated with them. We encourage you to learn as much as possible about the geography, geo-political environment, customs and cultural aspects of the region, climatic and altitude challenges, personal risks, travel risks. Our belief - "awareness minimises the shock!"
Passports and Visa:
All foreigners must carry a valid passport and have a valid visa for your booked trek when travelling with Indian Summits.. Please ensure your passport is valid for 6 months beyond the duration of the treks. It is your responsibility to ensure you have the appropriate visas for your holiday. Indian Summits cannot accept responsibility if you are refused entry to a country because you do not have the correct visa and passport documents. All Indian nationals must carry proof of identity.
Assumption of Risk:
While every effort will be made to ensure your safety and follow Indian Summits itineraries, in the event of political problems or natural difficulties which are beyond Indian Summits control and prevent our travelling to a particular area, Indian Summits reserves the right to substitute an alternative activity for that section of the trek. The cost of any such changes or delays shall not be the responsibility of agents or Indian Summits. By accepting Indian Summits terms and conditions you acknowledge your decision to travel on a Indian Summits trek is made after you have considered all relevant travel information supplied by Indian Summits and travel advice provided at any time by government bodies and associated agencies.
Waiver of Liability of Indian Summits
You acknowledge by accepting the terms and conditions of Indian Summits that the enjoyment and excitement of adventure travel is derived in part from the risks in travel and activity beyond the accepted safety of life at home or work and that these contribute to such enjoyment and excitement, and are a reason for your participation. You further agree to that if you suffer injury or illness, Indian Summits can at any cost, arrange medical treatment and emergency evacuation service, as they deem essential for your safety. In entering into this agreement you are not relying on any oral, written or visual representations or statements by Indian Summits or its staff or any other inducement or coercion to go on the adventure trek, but entirely of your own free will. By ticking or signing the acceptance and acknowledgement of understanding Indian Summits terms and conditions, you confirm that you accept liability for loss, injury, death, or damage, however caused which you may directly or indirectly suffer in connection with your trek within the extent permitted by law. By accepting Indian Summits terms and conditions you also waiver any and all claims you may now and in the future have against, and release from all liability Indian Summits, its service agents, independent contractors, employees, guides, porters, agents or representatives or sub-contractor for any personal injury, death, property damage, or loss you may sustain as a result of participation in a adventure trek with Indian Summits, its staff or sub-contractor . You also accept the physical exertion and that the weather extremes are subject to sudden unexpected change, remoteness from normal medical services and evacuation and its difficulties if you are disabled.
Indian Summits Services and Obligations:
Indian Summits supply services consisting of arranging and coordinating adventure travel, facilities and services and making bookings. Indian Summits undertake to perform these services with reasonable care and skill and will not be liable for any loss or damage which results from the act, default or omission of any person other than Indian Summits or any cause independent of human control. Indian Summits will endeavour to provide the most suitable services and arrangements to meet the particular requirements of any given trek. However travel is an individual experience, and your preferences and opinions may vary from Indian Summits. For this reason Indian Summits cannot take responsibility for your individual satisfaction.
This contract and all provision of the services and matters arising from it are governed by and in accordance with Indian law and any dispute arising with be subject to the Indian Courts.
Indian Summits reserves the right to take photographs of participants of a tour that may be used for promotional purposes. Participants who would prefer their image not be used must identify themselves to the trek leader at the commencement of a trek on day one at the team briefing.
